Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Kraty's live-ops platform, web dashboard, APIs, and SDKs (collectively, the "Service") provided by Kraty ("Kraty," "we," "us"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Account & Access

You must register a studio and a primary administrator to use the Service. Studios are responsible for the conduct of their members and the security of their API keys. Sharing credentials between humans is prohibited.

2. Acceptable Use

You agree not to:

• Use the Service for any activity that violates law or third-party rights.
• Probe, scan, or reverse-engineer the Service except as required for SDK integration.
• Submit content that infringes intellectual property or contains malicious code.
• Use the Service to operate illegal gambling, unauthorised lotteries, or chance-based mechanics in jurisdictions where such operations require licensure you do not hold.

3. Customer Data

You retain ownership of the data you submit to the Service, including player identifiers, event configurations, and reward configurations ("Customer Data"). You grant Kraty a non-exclusive, worldwide license to host, process, and transmit Customer Data solely to operate the Service for you.

Kraty does not sell Customer Data, does not use it to train models, and does not share it across studios. Specific data-handling commitments are in our Privacy Policy and, where applicable, in a Data Processing Addendum (DPA).

4. Fees & Billing

Paid plans are billed monthly in advance based on the plan you select. Usage above your plan's monthly active player (MAU) limit may incur overage charges as described on our pricing page or in a written order form.

All fees are non-refundable except where required by law. We will provide at least thirty (30) days' notice for price increases via email to your studio administrator.

5. Service Availability

We target 99.9% monthly uptime on paid plans, measured at the platform's public ingress. Scheduled maintenance is announced via the status page at least twenty-four (24) hours in advance where possible. SLA credits, if any, are listed in your order form; the Starter plan is provided as-is with no SLA.

6. Termination

You may cancel your subscription at any time from the dashboard. Cancellation takes effect at the end of the current billing period. We may suspend or terminate access for material breach of these Terms after written notice and a thirty (30) day cure period, or immediately for breaches that pose an imminent threat to the Service or other customers.

After termination, you may export Customer Data for ninety (90) days. After that window, we delete Customer Data on our standard rolling schedule (see Privacy Policy).

7. Warranties & Disclaimers

The Service is provided "as is." To the maximum extent permitted by law, Kraty disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. No statement made by Kraty personnel constitutes a warranty.

8. Limitation of Liability

To the maximum extent permitted by law, Kraty's aggregate liability for any claim arising out of or relating to the Service will not exceed the fees you paid to Kraty in the twelve (12) months preceding the claim. In no event will Kraty be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data.

9. Indemnity

You will indemnify Kraty against third-party claims arising from your Customer Data, your players' conduct, your live-ops design decisions, or your breach of these Terms. Kraty will indemnify you against third-party claims that the Service, as provided by Kraty, infringes a US patent or copyright, subject to the liability cap above.

10. Changes

We may update these Terms from time to time. Material changes will be announced at least thirty (30) days in advance via email to your studio administrator. Your continued use of the Service after the effective date constitutes acceptance.
